These Terms of Service govern your use of the BKNexchange website and application. By using the services, you agree to these terms.
By accessing or using the BKNexchange website or application, you agree to be bound by these terms. If you are using the services on behalf of a business, you represent that you are authorized to bind that business.
BKNexchange provides a modular workforce platform that may include Workforce Core for scheduling and timekeeping, Earned Wage Access, and Field Hub. Features and availability may change over time, and some services roll out on a state by state basis.
You must be at least 18 years old to use the services. You agree to provide accurate information, to keep your login credentials secure, and to be responsible for activity under your account.
Employers control their own workforce data and configure caps, eligibility, verification, and the services they enable. Employers are responsible for using the services lawfully and for running their own payroll. BKNexchange is not a payroll provider.
Earned Wage Access provides access to wages an employee has already earned for hours already worked. It is not a loan, cash advance, or line of credit, and it carries no interest or APR. Fees are disclosed before a transfer, availability varies by state, and access is based on hours verified by the employer.
Fees for paid services are described on our pricing page and are confirmed at signup. The Earned Wage Access monthly or usage based fee is billed to the employer, not the employee. Any per transfer fee is disclosed to the employee before each transfer, and an employer may choose to sponsor it. Fees may change with reasonable notice, and you are responsible for applicable taxes.
You agree not to misuse the services, including by using them unlawfully, infringing the rights of others, attempting to gain unauthorized access, interfering with normal operation, or reverse engineering the platform.
The services, including software, design, and content, are owned by BKNexchange and its licensors. We grant you a limited, non exclusive, non transferable right to use the services in accordance with these terms.
Some features rely on third party providers, such as payment and transfer partners. Your use of those features may also be subject to the provider terms.
The services are provided on an as is and as available basis, without warranties of any kind, to the fullest extent permitted by law.
To the fullest extent permitted by law, BKNexchange will not be liable for indirect, incidental, special, or consequential damages, and our total liability is limited as set out in any applicable agreement.
You agree to indemnify and hold BKNexchange harmless from claims arising out of your misuse of the services or your violation of these terms.
We may suspend or end access to the services if these terms are violated. You may stop using the services at any time.
These terms are governed by the laws of the State of [State], without regard to its conflict of laws rules. [Optional: add dispute resolution or arbitration terms here.]
We may update these terms from time to time. Continued use of the services after changes take effect means you accept the updated terms.
